IMPORTANT: Once review of the pharmacy application begins, the application will be CANCELLED if there is a:

  • Change of Ownership,
  • Change of Managing Officer (i.e. addition and/or removal of an officer), or a
  • Change of Location for the pharmacy

If this occurs, then the applicant must reapply for the license by submitting a new application packet and fee to the Board. All application fees are non-refundable.

Instructions for Submitting a New Pharmacy (Facility) Application

  • To successfully apply for a pharmacy license, the applicant must read and follow all instructions listed on the application forms. Failure to submit all the required documentation will result in a delay of licensure.

  • Application packets should be mailed with the fee to the Board address below. Currently, fees can only be paid by check or money order. Checks or money orders sent without the application will be returned to the sender as the Board will not know which application to apply the payment to.

  • Due to the high volume of applications received, the Board is unable to confirm the receipt of the application. Instead, consider using a mail courier with tracking notifications and/or delivery receipts to confirm the receipt of the application. The receiving Licensing Specialist will send the pharmacy an email to the email address provided on the application to notify if there are any deficiencies or if the application is considered complete at the time it is reviewed. This initial review process can take 1-2 weeks.

  • Keep a copy of the completed application for your own records. Once received by the Board, copies of the application may only be retrieved by submitting an Open Records Request.

  • Each class of pharmacy has their own separate pharmacy application packet to submit.

Pharmacy Applications & Instructions

Below is the list of all available pharmacy classes and applicable forms. Click on a pharmacy class to view the corresponding application.

 

Class A

Community Pharmacy

This license authorizes a facility located in Texas to dispense a drug or device to the public under a prescription drug order. This pharmacy may not engage in compounding sterile preparations. Includes “closed door” pharmacy.

 

Class A-S

Community Pharmacy Engaged in Compounding Sterile Preparations

This license authorizes a facility located in Texas to dispense a drug or device to the public under a prescription drug order and engage in compounding sterile preparations. Includes “closed door” pharmacy.

 

Class B

Nuclear Pharmacy

This license authorizes a facility located in Texas to dispense a radioactive drug or device for administration to an ultimate user.

 

Class C

Institutional/Hospital/Ambulatory Surgery Center Pharmacy

This license authorizes a facility located in Texas in one of the following:
  • a hospital maintained or operated by the state;
  • an inpatient facility including a hospital licensed under Chapter 241 or 577, Health and Safety Code;
  • a hospice inpatient facility licensed under Chapter 142, Health and Safety Code;
  • or an ambulatory surgical center licensed under Chapter 243, Health and Safety Code
This pharmacy may not engage in compounding sterile preparations.

 

Class C-S

Institutional/Hospital/Ambulatory Surgery Center Pharmacy Engaged in Compounding Sterile Preparations

This license authorizes a facility located in Texas in one of the following:
  • a hospital maintained or operated by the state;
  • an inpatient facility including a hospital licensed under Chapter 241 or 577, Health and Safety Code;
  • a hospice inpatient facility licensed under Chapter 142, Health and Safety Code;
  • or an ambulatory surgical center licensed under Chapter 243, Health and Safety Code
This also authorizes the facility to engage in compounding sterile preparations.

 

Class D

Clinic Pharmacy

This license authorizes a facility to dispense a limited type of drug or device under a prescription drug order.


NOTE: A Class D pharmacy license shall not be issued to a physician’s office. Texas State Board of Pharmacy Rules define Clinic Pharmacy (Class D) as a facility/location other than a physician's office, where limited types of dangerous drugs or devices restricted to those listed in and approved for the clinic's formulary are stored, administered, provided, or dispensed to outpatients. (e.g. planned parenthood, public health). See Board Rule 291.93.

 

Class E

Non-Resident (Out of State) Pharmacy

This license authorizes a facility located in a state other than Texas whose primary business is to
  • dispense a prescription drug or device under a prescription drug order; and
  • deliver the drug or device to a patient, including a patient in this state, by United States mail, common carrier, or delivery service.
This pharmacy may not engage in compounding sterile preparations.

 

Class E-S

Non-Resident (Out of State) Pharmacy Engaged in Compounding Sterile Preparations

This license authorizes a facility located in a state other than Texas whose primary business is to
  • dispense a prescription drug or device under a prescription drug order; and
  • deliver the drug or device to a patient, including a patient in this state, by United States mail, common carrier, or delivery service.

This license provides for engaging in compounded sterile preparations to be shipped to the state of Texas.

The Texas State Board of Pharmacy (TSBP) will not issue a license or renew a license for a Class E-S Pharmacy unless the pharmacy has been inspected by the Board or its designee to ensure the pharmacy meets the requirements laid out in the Texas Pharmacy Act and Rules. Class F

Freestanding Emergency Medical Care Center Pharmacy

This license authorizes a facility that is licensed by the Texas Department of State Health Services pursuant to Chapter 254, Health and Safety Code, to provide emergency care to patients.

 

Class G

Central Prescription Drug or Medication Order Processing Pharmacy

This license authorizes a facility established for the primary purpose of processing prescription drug or medication drug orders shall be licensed as a Class G pharmacy under the Act.


NOTE: A Class G pharmacy shall not store bulk drugs or dispense a prescription drug order.

 

Remote Pharmacy Services

Applications for Remote Pharmacy Services

Remote Pharmacy Services allow a Class A or a Class C pharmacy to provide pharmacy services in a facility that is not at the same location as the Class A or Class C Pharmacy.
